Virginia Notary Laws Explained in Plain English

Notary law sounds intimidating. It isn't. Virginia's notary rules are collected in Title 47.1 of the Virginia Code, and once you strip away the legalese they come down to a handful of simple principles that keep documents honest and protect everyone involved.

Who can be a notary in Virginia?

Virginia notaries are appointed by the Governor. To become one, an applicant must be at least 18, a U.S. citizen or legal resident, able to read and write English, and free of felony convictions unless rights have been restored. Notaries receive a four-year commission and can perform notarial acts anywhere in the Commonwealth.

What a notary actually does

A notary performs 'notarial acts.' The most common are:

• Acknowledgment, the signer confirms they signed the document willingly
• Jurat, the signer swears under oath that the contents of the document are true
• Oath or affirmation, the signer swears something orally
• Copy certification, the notary certifies that a copy is a true copy of the original (limited to certain documents)
• Signature witnessing, the notary watches the signer sign

Each act has its own certificate wording. Using the wrong certificate can invalidate the notarization.

The three things every notary must confirm

Before completing any notarial act, a Virginia notary must confirm three things:

1. Identity. The signer is who they say they are, verified by a current government-issued ID (or, in rare cases, by credible identifying witnesses).
2. Awareness. The signer knows what they are signing. Signers who are unconscious, heavily medicated, or unable to understand cannot be notarized for.
3. Willingness. The signer is signing freely, not under duress or coercion.

A notary who signs off without confirming these three things has failed the basic obligation of the office.

What Virginia notaries CAN'T do

Virginia notaries are not lawyers. Even a highly experienced notary cannot:

• Give legal advice
• Draft legal documents on your behalf
• Explain the legal effect of a document you are signing
• Choose which notarial certificate to use for you (you or your attorney decides)

When a notary suggests you speak with an attorney, they are following the law, not being unhelpful.

Fees

Virginia sets maximum notarial fees. Notaries can charge less, but not more. RON has its own slightly higher maximum. Travel fees for mobile notaries are separate and unregulated, but a professional notary always discloses them in advance.

The journal

Virginia notaries are required to keep a record of every notarial act. The journal records the date, the signer's name, the document type, and the type of act performed. This is what protects you if a document is ever challenged, there is a contemporaneous record that the notarization happened, when, and involving whom.

RON specifics

Virginia Code § 47.1-2 and related regulations authorize Remote Online Notarization. RON notaries must use approved platforms with multi-factor identity proofing, record the video of the session, retain the video for at least five years, and apply electronic seals to the finished document. The legal effect is the same as an in-person notarization.

The bottom line
